So it seems I guess the buybacks are actually because of the Lemon Laws and not just Hyundai using the Lemon Laws to calculate the amounts for the buybacks as we had assumed. I guess that makes more sense why they denied my buyback request also since I'm in CA and my 2019 has 35k miles on it. Our Lemon Law states it only covers up to 18k miles.

It looks like NJ's lemon law covers up to 24k miles, so I'm guessing you're over that too?

And it sounds like BlueKonaEV's buyback with 50k miles was because he's in Florida where they don't have a mileage limit.

So I guess the conclusion is, move to PA (where they have a good mileage calculation), and then initiate buyback.

Edit: Scratch that theory.. Mattsburgh is in PA and their Lemon law states 12 months, 12k miles.. so under this theory Mattsburgh probably wouldn't have qualified. OK.. Do not move to PA!

NJ has a great lemon law - it covers anything under 24k miles and 2 years from delivery. I'm at 15k miles and 18 months, so I definitely qualify. If Hyundai continues being difficult I'll just file a claim and force their hand.

Where are you located? Here in Vancouver area, we are near summer weather now, and that has really improved my range. Pretty well back to where it was last summer. I should mention, to get the best range reading, I momentarily shut off Climate. That gets me an extra 20 or 30 kms.

And I am current on all my recalls and software updates. The last one (a couple months ago) I did had something to do with efficiency. So if you are not up to date, maybe that could be your issue.

I won’t have time to go out and get mine notarized until Friday. No big deal, though. The longer the delay the better for me. Until my daughter goes off to college in August, we’ll be fighting over the spare car

It’s probably just a standard agreement contract, drafted up by some corporate lawyer who has to justify their high salary. The details really aren’t much of a secret. They’re just following the lemon law formulas for the jurisdiction that applies to you.

Also, in states where the buyback amount is not prescribed but negotiated, they have a valid business interest in keeping someone to whom they had to give an exceptional deal from making it public.

Keeping it confidential was in my settlement agreement, so I can't disclose details but all I can say is that they are going exactly by state lemon law (of the state you reside)

I honestly wonder if I should just eat the registration fees and sign my offer they sent 2 weeks ago. They have to reimburse me for any payments made after their calculation was completed so I am not worried about that, but I had no idea that when I asked them to include my 2 most recent payments and registration fees this would take WEEKS. I just want to be free of the Kona at this point.

I very much relate to and empathize with your frustration. Just to save your sanity I would double whatever time estimate they give you. I have been working with Sedgewick since 5/7 and got my first offer 6/10 which was missing some items. I finally got a response today after calling/emailing multiple people essentially telling me they are still waiting on word back from Hyundai, but the matter has been escalated to a manager who is out until next Wednesday.

From my experience, you will not hear anything in terms of progress updates until you have their formal offer and this could take 4 weeks. I know it doesn't help matters, but you're not alone in terms of your experiences. It is frustrating that some people seem to have better experiences and I can only chalk that up to luck.

Strange. I keep getting the runaround with what is happening with my car. Took weeks to get my case manager on the phone and then she said she would look into the buyback option as well as getting a battery and get back to me--note: my car does not run at all and has been at the dealer for 2 months now. Case Manager was supposed to call me this past Tuesday and never called. Got her on the phone yesterday and it was clear she had done nothing but said she would call back in an hour or two. No call back. I emailed her this morning and luckily got a call. She said she was elevating my ticket and I should hear from someone soon. I got an email today from a "Customer Service Specialist" who said she needs to contact my dealer to review the open repair order and that it could take her 7-10 days to follow up. No mention of any buyback or even battery replacement.. Live in NYS

Maybe call the customer service line again and check to make sure they have your phone number correct? It took them I think 9 business days for them to call me. Could also be getting slower as the queue might have been growing now.

Sorry, I misread your post. I am talking about Sedgwick. I received a case # on 4/20 after filing a complaint with Hyundai Consumer Affairs. I was offered a buyback/repurchase 1 week later on 4/27 and then transferred to Sedgwick (the company that handles all the calculations for Hyundai) who reached out on 5/7. This is when I stopped hearing from anyone until I would reach out and even then I would get very little if any response back and excuses about why it was taking longer than expected. In my experience, HCA was pretty quick in getting back to me.

Was your car under two years and 18,000 miles when the defect first appeared? If so, it looks to me like you are entitled to a refund or replacement under the New York State Lemon Law.

According to the fact sheet, "... if your car is out of service to repair the problem for a total of 30 days during the warranty period ... then you may be entitled to either a comparable car or a refund of your purchase price, plus license and registration fees, minus a mileage allowance only if the vehicle has been driven more than 12,000 miles."

If this applies, tell them you want a new car or a buyback under the lemon law.
